If you are arrested and your BAC (blood alcohol content) is found to be over the legal limit of 0.08%, within two hours of driving, you will be charged with DUI. Depending on the number of prior DUI convictions and other factors in your case, you could face penalties of fines ranging from roughly $1,500 to $3,500 (plus additional fees for the cost of classes, incarceration, probation fees, etc.), jail time, mandatory ignition interlock device installation and other penalties. If your BAC is found to be 0.15% or higher then you will be charged with extreme DUI which carries much harsher penalties upon conviction. If you are a commercial driver, the legal BAC limit is 0.04%. If you are under the age of 21, any BAC above 0.00% will cause you to be charged with drunk driving.
