Gilbert First Time DUI

Work With an Experienced Gilbert DUI Lawyer

If you have been charged with DUI in the Town of Gilbert or anywhere in the State of Arizona, you could be facing significant penalties upon conviction such as jail time, steep fines, ignition interlock device installation, and alcohol treatment classes, among other consequences. Depending on the number of prior criminal convictions and other circumstances surrounding your arrest, the charges and subsequent penalties could be more serious. Even a first time DUI, with no prior convictions or other aggravating factors being considered, can result in harsh penalties so it is important that you have skilled representation on your side to challenge the state's evidence and preserve your legal rights in court.

For a first time (non-extreme) DUI conviction, involving alcohol or drugs and with an alcohol concentration between 0.08% and 0.149% (0.04% or higher for CDL drivers) you could be facing the following penalties:

  • Up to 10 days in jail (the court may suspend all but 24 hours of your sentence after successful completion of alcohol screening)
  • Minimum fines of approximately $1,500
  • Additional fees can include incarceration costs, fees for alcohol treatment classes, probation fees and the cost of the ignition interlock device
  • Up to five years of probation
  • Up to a one-year license suspension
  • Mandatory ignition interlock device installation for 12 months (required for alcohol convictions, but optional by court for drug only convictions)
  • If you are under 21 – a 30-day vehicle impound
  • Community work service hours

These penalties become progressively harsher if you are convicted of Extreme DUI, Super Extreme DUI, Aggravated DUI, and if you have prior DUI convictions on your record. These penalties can negatively impact a person's daily responsibilities, especially if you rely on your license for transportation to commute to the workplace. In addition to these penalties, you will have a mark on your permanent record that will follow you for the rest of your life. If you are a commercial driver, you could risk losing your job if convicted of a DUI and jeopardize future employment prospects.

We hired Trent Buckallew to represent our son following a second MIP ticket he received while in college. Mr. Buckallew kept us informed throughout all proceedings and helped us receive the satisfactory outcome of dropped charges in exchange for taking an alcohol awareness class. He was personable, knowledgeable and treated our small case with care and compassion. We would highly recommend him to anyone in need of representation. SR

Trent handled cases for me on two different occasions involving tickets for seat belt violations in commercial vehicles. Very happy with results. All charges dismissed. One case in Flagstaff and one case in Gilbert Court. KF
