Super Extreme DUI Penalties

'Super' extreme DUI refers to instances in which your blood alcohol concentration (BAC) is 0.20% or greater within two hours of driving or being in actual physical control of a vehicle. The mandatory minimum penalty for a first time 'super' extreme DUI includes 3 days in jail, 11 days home arrest (in certain circumstances), suspension of your driver’s license for 90 days to 1 year, and up to 5 years’ probation. Your vehicle will be impounded for 30 days and you will be required to use an ignition interlock device and participate in alcohol screening, monitoring and counseling. You will also be required to pay (not less than) a $500 fine, a $1,000 DUI abatement fee, a $1,000 prison construction fee and $1,000 to the state general fund. Maximum penalties for a first time 'super' extreme DUI can include 6 months in jail, a $1,000 fine with an 84% surcharge, $250 abatement fee, $1,250 equipment fund fee, $1,250 prison construction fee, a 1-year revocation of driver's license, and ignition interlock device requirement.
