<p>With multiple events going on in February, including Super Bowl LVII, the Waste Management Open, and the Barrett Jackson Car Auction, hundreds of thousands of people descended upon the Valley of the Sun. According to the Super Bowl Host Committee, close to 300,000 visitors came through the NFL Experience in downtown Phoenix, including nearly 25,000 fans in Margaret T. Hance Park for the Super Bowl Sunday watch party. (Fox 10 Phoenix 2/23/23)</p>



<p>Other Super Bowl events were held throughout the valley, including the Old Town Scottsdale Main Street Tailgate, a Super Bowl Gospel Celebration in Mesa, a Super Bowl Music Fest in Phoenix, and of course the Super Bowl itself took place in Glendale, AZ at the State Farm Stadium.</p>



<p>Sky Harbor International Airport broke records on Monday, the day after SBLVII as over 200,000 fans were returning back to their hometowns after the big game.  (AZCentral.com 2/16/23)</p>



<p>With the multiple events going in during the month of February, there were likely an increase in arrests during that timeframe. The types of cases we have seen so far have primarily involved alcohol violations, including DUI and Minor in Possession/Consumption as well as Disorderly Conduct cases. Multiple City, State, and Federal law enforcement agencies also performed a sex-trafficking sting operation across the Valley, which resulted in several arrests, including 300 misdemeanor and 48 felony arrests involving 120 arrests for ‘sex buyers’ and 35 arrests for prostitution. Law enforcement agencies have not provided additional information on the other arrests, citing that they are “open investigations”, although, according to court records, 6 of the arrests involved ‘soliciting sex from minors’. (AZ Republic 2/26/23)</p>

<p>If you were cited and/or arrested on a misdemeanor criminal violation by the Mesa Police Department, you will likely be appearing in the Mesa Municipal Court. The Mesa Municipal Court has jurisdiction over misdemeanor offenses such as DUI (1st Time DUI, Extreme DUI, Super Extreme DUI, Underage DUI), Assault, Disorderly Conduct, Criminal Damage, Domestic Violence and other criminal misdemeanor charges as well as traffic violations, Orders of Protection and Injunctions Against Harassment. <p>While your attorney will facilitate the court proceedings and give you instructions regarding your role during these various proceedings, it is always helpful to understand basic courtroom etiquette, including being on time, being polite to all court personnel, opposing counsel and the Judge, turning off electronic devices/phones and dressing appropriately. You want to make a good impression and impress upon the Court and Prosecutor that you are taking your case very seriously, and as such, your appearance and what you wear is important. Clothing should be free of offensive/controversial slogans, and no hats, cut-off shorts or flip-flops should be worn. Your appearance should not distract from your case or your defense and recommended attire would be ‘business casual’ such as a tucked in collared shirt and slacks for men and a blouse or sweater and slacks for women.</p>

<p> How to Post Bond at 4<sup>th</sup> Avenue Jail </p>



<p> If a friend or member of your family has been arrested and booked into jail in Maricopa County and the Judge ordered that a bond be posted for their release, you may be wondering how to go about posting this bond. Bonds can be paid at the 4<sup>th</sup> Avenue Jail (north side of the building), located at: </p>

<p>Phoenix, AZ 85003</p>



<p> Please note, the jail does not accept cash or credit cards – acceptable means of payment for posting a bond include, a Cashier’s Check, a U.S. Postal Money Order or a Western Union Money Order. These must be made payable to the <u>Maricopa County Sheriff’s Office</u>. </p>



<p>Once a bond is posted, it can take up to 48 hours for the inmate to be released. Also, please note: If an inmate has any other holds, including an immigration hold or a hold by another law enforcement agency, posting the bond will not enable the inmate to be released. If you have any questions or want to confirm any other possible holds that may prevent the inmate’s release, you may contact the Sheriff’s Information Management Services at (602) 876-0322. You will need the person’s full name, date of birth, and booking number (if you have it).</p>



<p>Also notable, any transactions over $10,000 will require that you provide your social security number in order to post the bond, which is a requirement of the Internal Revenue Service.</p>

<p>As Glendale is gearing up to host the Seattle Seahawks and the New England Patriots on February 1<sup>st</sup> we want to welcome an estimated 100,000 out of town visitors expected to visit the Valley of the Sun for <strong>Super Bowl XLIX</strong>. According to AZCentral.com, <a href="/Areas-We-Serve/Phoenix.aspx" rel="noopener noreferrer" target="_blank">Phoenix</a> area airports (including Scottsdale Airport, Phoenix Deer Valley Airport, Goodyear Airport, Glendale Municipal Airport, Mesa’s Falcon Field Airport, Phoenix-Mesa Gateway Airport, Chandler Municipal Airport, and of course Phoenix Sky Harbor International Airport) have been preparing for this increased air traffic for several months, anticipating over 1,000 additional private aircraft along with commercial and charter jets. </p>



<p>The NFL will be hosting the Super Bowl Experience activities at the Phoenix Convention Center the week leading up to the super bowl. According to azsuperbowl.com – along with the many interactive attractions, games, exhibits and other activities, fans will also be able to find many other venues and activities around town including the 2015 Pro Bowl on January 25<sup>th</sup> at University of Phoenix Stadium, the 2015 Waste Management Phoenix Open at TPC Scottsdale (1/26/15-2/1/15), Super Bowl XLIX Media Day (1/27/15), Verizon Super Bowl Central – a free, family-friendly, football themed outdoor fan fest taking over Downtown Phoenix (1/28/15-2/1/15), along with many other events leading up to the big game.</p>



<p>And of course with any event of this scale, law enforcement agencies from around the valley are coordinating efforts to ensure the safety of all residents – both locals and visitors alike. With a week filled with Super Bowl events spread across the valley between Glendale, Phoenix and <a href="/Areas-We-Serve/Scottsdale.aspx" rel="noopener noreferrer" target="_blank">Scottsdale</a>, police officers from Glendale PD, Phoenix PD and Scottsdale PD will be working off-duty shifts in addition to all regularly scheduled shifts in these departments. Additionally, other agencies – both local and federal, are providing the assistance of their officers, including <a href="/Areas-We-Serve/Gilbert.aspx" rel="noopener noreferrer" target="_blank">Gilbert</a> PD, <a href="/Areas-We-Serve/Tempe.aspx" rel="noopener noreferrer" target="_blank">Tempe</a> PD, Mesa PD and Prescott PD, along with regional cooperation of over 50 agencies. The City of Phoenix is hosting the major events – both Super Bowl Central covering several blocks in downtown Phoenix, as well as the Super Bowl Experience at the Phoenix Convention Center. <p>According to a recent report in <em>The State Press </em>(8/21/13), <a href="/Areas-We-Serve/Tempe.aspx" rel="noopener noreferrer" target="_blank">Tempe</a> police officers began increasing their patrols with the start of the fall semester at ASU. They have launched a task force – Operation Safe and Sober – which will include saturation patrols around campus and surrounding areas in Tempe, beginning August 15 and continuing through the end of the month. Tempe police officers will be on the lookout for minors consuming alcohol, driver’s under the influence of alcohol (or drugs), out-of-control parties and other related criminal violations. Their goal is to try and send a message to students early in the school year in an effort to help alleviate potential trends in these types of activities. The Tempe Police Department will also be working the night DUI task force with officers from other agencies, including MCSO, <a href="/Areas-We-Serve/Scottsdale.aspx" rel="noopener noreferrer" target="_blank">Scottsdale</a> PD, <a href="/Areas-We-Serve/Gilbert.aspx" rel="noopener noreferrer" target="_blank">Gilbert</a> PD, <a href="/Areas-We-Serve/Mesa.aspx" rel="noopener noreferrer" target="_blank">Mesa</a> PD and ASU PD. In addition to DUI and party patrols, officers will also focus on traffic violations, aimed primarily at pedestrians and bicyclists. While warnings will be issued during the first week of school for traffic violations, officers will begin strict enforcement of alcohol related violations right away. </p>



<p>Since the launch of Operation Safe and Sober, Tempe PD reported 371 arrests during the first week and another 486 arrests during week two of the campaign. Of the 371 arrests during the first week, there were 111 <a href="http://www.arizonaduidefenselawfirm.com/DUI/Minor-in-Consumption.aspx" rel="noopener noreferrer" target="_blank">Minor in Possession of Alcohol</a> arrests, 91 <a href="http://www.arizonaduidefenselawfirm.com/DUI.aspx" rel="noopener noreferrer" target="_blank">DUI</a> arrests, 17 <a href="http://www.arizonaduidefenselawfirm.com/DUI/Extreme-DUI.aspx" rel="noopener noreferrer" target="_blank">Extreme DUI</a> arrests, 14 <a href="http://www.arizonaduidefenselawfirm.com/DUI/Driving-Under-the-Influence-of-Drugs.aspx" rel="noopener noreferrer" target="_blank">DUI-Drugs</a> arrests, 6 <a href="http://www.arizonaduidefenselawfirm.com/DUI/Underage-Drivers.aspx" rel="noopener noreferrer" target="_blank">Underage DUI</a> arrests, 2 <a href="http://www.arizonaduidefenselawfirm.com/DUI/Aggravated-DUI.aspx" rel="noopener noreferrer" target="_blank">Aggravated DUI</a> arrests and 54 calls for loud parties, among other various arrests. Arrests during the second week of the campaign include 208 for Minors in Possession of Alcohol, 85 for DUI, 68 calls for loud parties, and 14 for Minors, under the age of 18, in possession of alcohol. </p>



<p>Tempe PD has also incorporated an educational facet to this campaign and has been talking with students regarding alcohol, laws and safety measures.</p>

<p>Country Thunder is an annual weekend music festival held in Florence, AZ (Pinal County) drawing thousands of people from across the valley. In fact, this year’s event sold out for the first time in its 20-year history, reaching a capacity crowd of 25,000 patrons.</p>



<p>In years past, Underage Drinking has been a concern at this event, and last year 189 people were arrested for Underage Drinking and other related crimes. In many cases, underage drinkers were alleged to have had blood alcohol levels at more than twice the legal limit of .08 percent, and the youngest person arrested was 15 years old. In addition to Underage Drinking, citations also included violations of <a href="http://www.arizonaduidefenselawfirm.com/DUI/Minor-in-Consumption.aspx" rel="noopener noreferrer" target="_blank">Minor in Possession of Alcohol</a>, Using a Fake ID to buy Alcohol, and Furnishing Alcohol to a Minor.</p>



<p>According to recent reports during this year’s event, the Pinal County Sheriff’s office arrested a 20-year old man on suspicion of <a href="/Criminal-Defense/Disorderly-Conduct.aspx" rel="noopener noreferrer" target="_blank">Disorderly Conduct</a> and <a href="/Mesa-Criminal-Defense-Blog/2012/April/Aggravated-Assault-Charges-in-AZ.aspx" rel="noopener noreferrer" target="_blank">Aggravated Assault</a>, after reports of a stabbing, leaving a 36-year old man in critical condition. </p>



<p><a href="/Criminal-Defense/Assault.aspx" rel="noopener noreferrer" target="_blank">Aggravated Assault</a> charges are taken very seriously in AZ and involve Assault cases where a weapon is used, where there is serious physical injury, when the Assault causes a fracture or temporary loss of use of a bodily organ or function, or if the victim is under 15 and the aggressor is over 18. If the offense involves any type of weapon or dangerous instrument (including a car) the Aggravated Assault will be alleged to be a “dangerous” crime which then means if a person is convicted the penalty is mandatory imprisonment, and the length of that prison sentence is enhanced as compared to a non-dangerous crime. “Dangerous” crimes are not probation eligible, but can become probation eligible if the “Dangerous” allegation is dismissed – a common strategy in plea negotiations.</p>



<p>Every case presents with unique facts, and consequently the sentencing range for Aggravated Assault charges can range anywhere from a designated misdemeanor offense (reduced from a felony) with no jail time all the way to mandatory prison up to 21 years for a first offense class 2 dangerous felony.</p>

<p> If you have been charged with disorderly conduct, you may be a bit confused about the crime for which you have been accused. <a href="/Criminal-Defense/Disorderly-Conduct.aspx" rel="noopener noreferrer" target="_blank">Disorderly conduct</a> can be a confounding charge, because it is a very broad and subjective criminal violation which involves various offenses such as disturbing the peace or causing a commotion. In Arizona, the criminal statutes define disorderly conduct and outline which offenses can constitute this particular crime. </p>



<p> The Arizona State Legislature delineates in §13-2904 that this crime is committed when any person disturbs the peace or quiet of a neighborhood, family, or person. A person can be charged with disorderly conduct in Arizona if he/she engages in fighting or any violent or other disruptive behavior. While a person may also be charged with assault for this type of behavior, it will depend upon the circumstances of the incident. Often-times a person is charged with disorderly conduct combined with other violations, such as <a href="/Criminal-Defense/Assault.aspx" rel="noopener noreferrer" target="_blank">assault</a>, <a href="/Criminal-Defense/Disorderly-Conduct.aspx" rel="noopener noreferrer" target="_blank">criminal damage</a> and other similar violations. </p>



<p>Additionally, if a person makes unreasonable noise with disregard to others, or uses abusive and offensive language or gestures towards any other person present that is likely to provoke physical retaliation, this can be considered disorderly conduct. It is also disorderly conduct to make a protracted commotion with the intent to prevent the transaction of a business in a lawful meeting, gathering or procession.</p>



<p>For example, unnecessary gestures and motions to prevent a transaction can be considered disorderly conduct in some circumstances. Also, if a person refuses to obey lawful order and disperse after he or she is told that he or she is breaking fire code or is not acting in the best interest of the safety of others, this be considered disorderly conduct. Recklessly handling, displaying, or discharging a deadly weapon or another dangerous instrument is considered a class 6 felony charge, whereas all other behaviors described above are considered a Class 1 misdemeanor charge.</p>

<p>Queen Creek is a small town situated in southeast Maricopa County, with the southern portion of town overlapping into Pinal County. <p>The Apache Junction Justice Court is in Pinal County and located at 575 North Idaho Road, in <a href="/Areas-We-Serve/Apache-Junction.aspx" rel="noopener noreferrer" target="_blank">Apache Junction</a>, AZ. This court covers the <a href="/Areas-We-Serve/San-Tan-Valley.aspx" rel="noopener noreferrer" target="_blank">San Tan Valley</a>, Gold Canyon and Apache Junction. According to the court’s website, the Apache Junction Justice Court ranks at number 17 out of 80 Justice Courts in Arizona for total case filings in 2011. There were just over 2,000 misdemeanor case filings, which included 410 <a href="/Criminal-Defense/DUI.aspx" rel="noopener noreferrer" target="_blank">DUI case</a> filings, 76 serious traffic case filings and a variety of other non-DUI criminal filings. There were also close to 700 Orders of Protection and Injunctions against Harassment filed last year. </p>

<p><strong>What is a crime involving moral turpitude?</strong></p>



<p>According to Black’s Law Dictionary, moral turpitude is defined as “Conduct that is contrary to justice, honesty or morality.” It is important to understand the consequences if convicted of a crime involving moral turpitude (CIMT), particularly as it relates to immigration matters. These types of crimes can also have an impact on a person’s ability to pursue meaningful employment, as prospective employers may call into question, a person’s honesty or integrity if these types of crimes are found during a background search.</p>



<p>What types of crimes are deemed to be crimes involving moral turpitude? The more common crimes include the following:</p>



<ul class="wp-block-list">
<li> <strong>Crimes against a person </strong>such as <a href="/Criminal-Defense/Violent-Crimes.aspx" target="_blank" rel="noopener noreferrer">Murder</a>, Voluntary or Reckless <a href="/Criminal-Defense/Violent-Crimes.aspx" target="_blank" rel="noopener noreferrer">Manslaughter</a>, and Kidnapping are considered CIMT’s. Immigration law also considers Child Neglect, <a href="/Criminal-Defense/Domestic-Violence/Elder-Child-Abuse.aspx" target="_blank" rel="noopener noreferrer">Child Abuse</a>, <a href="/Criminal-Defense/Domestic-Violence.aspx" target="_blank" rel="noopener noreferrer">Domestic Violence</a>, Stalking and repeated Harassment as CIMT’s. </li>



<li> <strong>Sexual Offenses </strong>such as Rape, <a href="/Criminal-Defense/Sex-Crimes/Prostitution.aspx" target="_blank" rel="noopener noreferrer">Prostitution</a> and Possession of <a href="/Criminal-Defense/Sex-Crimes/Child-Pornography.aspx" target="_blank" rel="noopener noreferrer">Child Pornography</a> are considered CIMT’s. </li>



<li> <strong>Crimes Against Property </strong>such as Breaking and Entering to commit Larceny, crimes of <a href="/Criminal-Defense/Theft-Crimes.aspx" target="_blank" rel="noopener noreferrer">Theft</a>, and Trafficking in Counterfeit Goods are considered CIMT’s. </li>



<li> <strong>Crimes Involving Fraud </strong>– Most crimes involving Fraud either against the government or individuals are considered CIMT’s, as well as making false statements to obtain a passport, driver’s license, firearm application, passing bad checks, and fraudulent use of a social security number. </li>
</ul>



<p> The immigration consequences, if convicted of a Crime Involving Moral Turpitude can lead to deportation under U.S. immigration statutes, if an alien has no U.S. immigration status. The alien is subject to exclusion from the U.S. for a minimum of 15 years and can also establish a basis for deportation, under certain circumstances, of aliens who have some immigration status, according to a recent article in <strong><em>The Champion </em></strong>magazine (published by NACDL). Because of the significant immigration consequences associated with Crimes Involving Moral Turpitude, it is critical to seek the advice of an experienced attorney who understands the impact of these types of crimes, before making any decisions in your case. </p>



<p> Not only can these crimes have an impact on immigration status, but CIMT’s can also have long term consequences for citizens of this country, particularly in an individual’s pursuit of a meaningful career. It can be very difficult to gain employment with a criminal record and the stigma of this record can follow a person for a lifetime. While there are laws protecting individuals from employment discrimination, public employers in the State of Arizona may deny employment to an individual with a criminal record if there is a reasonable correlation between the type of conviction and the position being sought after. For example, if a person has a drug conviction, an employer may determine that this will have no impact on handling the duties of an office clerk, if that individual is otherwise qualified. However, if the person is seeking a position as a pharmacist, then the drug conviction may be an impediment to obtaining a position in this field. As such, employers such as banks or other financial institutions, cashiers, or other positions that involve the handling of money or other valuable items, may be hesitant to hire someone who has been convicted of <a href="/Criminal-Defense/Theft-Crimes.aspx" rel="noopener noreferrer" target="_blank">Theft</a>, Fraud, Financial Crimes, or other Crimes Involving Moral Turpitude. Because the laws regarding employment, with respect to convictions of crimes involving moral turpitude are riddled with complexities, it is imperative that you seek the advice of legal counsel before making any decisions that may have a long lasting impact on your livelihood. </p>

<p>Are ‘Bath Salts’ Illegal in Arizona?</p>



<p>According to a recent article by Arizona State University’s <strong><em>State Press, </em></strong>Arizona Senate and House Bills were recently signed into law by Governor Brewer, making the “creation, sale and use” of chemicals used in making Bath Salts illegal in the State of Arizona. These designer drugs have become increasingly sought-after given the widespread availability and access to these drugs, the ease in which they can be made, and the belief that the affects mimic those of methamphetamines, ecstasy and cocaine. One of the growing concerns is that it is easy to circumvent existing laws against these types of drugs – Bath Salts (other common names include Blue Silk, Cloud 9, Drone, Stardust, Vanilla Sky, and White Lightning), Spices, and other similar drugs, by substituting one or more of the ‘banned’ ingredients. Some of the reported effects after ingesting these kinds of drugs have included nausea, paranioa, elevated heart rate, irritability, aggressive and violent behavior, hallucinations, seizures, and perspiration which can lead to individuals removing their clothing and subsequently being found naked after using Bath Salts. Local news reports also cite an addiction specialist at a drug and alcohol rehab center in <a href="/Areas-We-Serve/Scottsdale.aspx" rel="noopener noreferrer" target="_blank">Scottsdale</a> who has indicated that addiction to bath salts has increased over 200 percent in the past 6 months. U.S. Poison Control Centers have also reported a massive increase in the number of Bath Salts related calls received, with zero reports in 2009, 302 reports in 2010 and 4,000 reports in 2011, according to a news release by the City of Tucson Police Department. </p>



<p>According to the <strong><em><a href="/Areas-We-Serve/Phoenix.aspx" rel="noopener noreferrer" target="_blank">Phoenix</a> New Times</em></strong>, the <a href="/Areas-We-Serve/Tempe.aspx" rel="noopener noreferrer" target="_blank">Tempe</a> Police Department has reported multiple allegations recently of individuals affected by Bath Salts. In one instance, a 23-year old was allegedly found slamming himself against walls and then running nude through a Tempe neighborhood after admitting to ingesting Bath Salts. In another incident, a 21-year old crashed his truck in a parking garage of an apartment complex near Arizona State University. According to witnesses, the individual was fully naked when he got out of his vehicle, and later admitted to police that he had taken Bath Salts. According to court documents, this individual – an ASU student, now has a <a href="/Criminal-Defense/DUI.aspx" rel="noopener noreferrer" target="_blank">DUI charge</a> pending against him. In the third instance, an 18-year old was found in the bathroom at a local coffee shop in Tempe, allegedly barricading himself in the bathroom and when entry was gained by Tempe Police, he was said to be completely naked, acting delusional and claimed he was being eaten alive by bugs. Police say he is facing a <a href="/Criminal-Defense.aspx" rel="noopener noreferrer" target="_blank">criminal damage</a> charge as the bathroom was allegedly “trashed” with broken mirrors and covered with “quite a bit of blood”. There was also a recent case where Tempe Police pulled a naked man out of Tempe Town Lake and another report of a carjacking in <a href="/Areas-We-Serve/Scottsdale.aspx" rel="noopener noreferrer" target="_blank">Scottsdale</a> by a naked man – both allegedly under the effects of Bath Salts. </p>



<p>The manufacture, sale and use of Bath Salts has been banned both on local and state levels here in Arizona, as well as at the federal level. Resulting charges from using, selling, or manufacturing Bath Salts, or any other illegal drugs, can include Driving Under the Influence (<a href="/Criminal-Defense/DUI.aspx" rel="noopener noreferrer" target="_blank">DUI</a>), <a href="/Criminal-Defense/Drug-Crimes/Possession.aspx" rel="noopener noreferrer" target="_blank">Drug Possession</a>, <a href="/Criminal-Defense/Drug-Crimes.aspx" rel="noopener noreferrer" target="_blank">Drug Use</a> or <a href="/Criminal-Defense/Drug-Crimes.aspx" rel="noopener noreferrer" target="_blank">Drug Sales</a>, <a href="/Criminal-Defense/Disorderly-Conduct.aspx" rel="noopener noreferrer" target="_blank">Disorderly Conduct</a>, Criminal Damage, <a href="/Criminal-Defense/Assault.aspx" rel="noopener noreferrer" target="_blank">Assault</a>, and other criminal violations. <p><strong>What are Protective Orders?</strong></p>



<p>Individuals seeking to restrain a person from acts of <a href="/Criminal-Defense/Domestic-Violence.aspx" rel="noopener noreferrer" target="_blank">domestic violence</a>, harassment, coming near a residence, place of employment or school can obtain a Protective Order in any court in the State of Arizona. If you reside in <a href="/Areas-We-Serve/Scottsdale.aspx" rel="noopener noreferrer" target="_blank">Scottsdale</a>, chances are you will be seeking an order in the Scottsdale City Court, or other nearby City/Municipal or Justice Courts in your community, including Paradise Valley Municipal Court, Biltmore Arcadia Justice Court, Desert Ridge Justice Court or McDowell Mountain Justice Court. An <a href="/Criminal-Defense/Domestic-Violence/Restraining-Orders.aspx" rel="noopener noreferrer" target="_blank">Order of Protection</a> is generally requested when an individual is seeking protection against a spouse, former spouse, roommate, or other blood relative. If the person you are requesting the Order against does not qualify as a spouse, relative, roommate, or other designated domestic relationship, you will need to request an Injunction Against Harassment instead of an Order of Protection. An Injunction is typically sought when disputes arise between neighbors, co-workers, or other non-domestic relationships. </p>



<p>When requesting an Order of Protection, a Judge can issue the Order if he/she finds that the defendant may, or has committed an act of domestic violence. <a href="/Criminal-Defense/Domestic-Violence.aspx" rel="noopener noreferrer" target="_blank">Domestic Violence Crimes</a> can include <a href="/Criminal-Defense/Assault.aspx" rel="noopener noreferrer" target="_blank">Assault</a> or Aggravated Assault, <a href="/Criminal-Defense/Domestic-Violence/Elder-Child-Abuse.aspx" rel="noopener noreferrer" target="_blank">Child Abuse</a>, Criminal Damage, Crimes Against Children, <a href="/Criminal-Defense/Disorderly-Conduct.aspx" rel="noopener noreferrer" target="_blank">Disorderly Conduct</a>, Harassment, Threatening and Intimidating and other related crimes. The Judge may order either party not to commit acts of Domestic Violence; prevent either party from coming near the residence or place of employment; grant one party full use of the residence; and order any other relief that may be necessary to ensure protection. The Judge may also prohibit the Defendant from possessing or purchasing any firearms as a condition of the Order, and shall subsequently order the Defendant to turn over any firearms to the appropriate law enforcement agency. </p>



<p>If the Judge issues the Order of Protection, it is the Plaintiff’s (requestor’s) responsibility to have the Defendant served before the order will become effective. Once served, the Order is in effect for twelve months. During this time, the Defendant can request one hearing any time during the twelve month effective date. The Judge will hear testimony and make a determination whether the Protective Order should be quashed or upheld. If at any time during this twelve month time frame the defendant violates the Order of Protection, he or she can be charged criminally for <a href="/Criminal-Defense/Domestic-Violence/Violation-of-Restraining-Orders.aspx" rel="noopener noreferrer" target="_blank">violating the Order of Protection</a> or Injunction Against Harrassment.</p>

<p>Phoenix Area Prostitution and Solicitation Charges</p>



<p><a href="/Criminal-Defense/Sex-Crimes/Prostitution.aspx" rel="noopener noreferrer" target="_blank">Prostitution</a> is defined as engaging in or offering to engage in sexual conduct with a person in exchange for money or any other valuable consideration such as food, drugs, shelter or clothing. Police use a variety of tactics to address <a href="/Criminal-Defense/Sex-Crimes/Prostitution.aspx" rel="noopener noreferrer" target="_blank">prostitution</a>, including having female officers pose as prostitutes or having undercover officers arrest individuals accused of <a href="/Criminal-Defense/Sex-Crimes/Prostitution.aspx" rel="noopener noreferrer" target="_blank">soliciting a prostitute</a>. </p>



<p>Prostitution is classified as a Class 1 Misdemeanor in most cases. A person convicted of prostitution will face the following <strong><u>mandatory</u></strong> jail term:</p>



<p>First offense – not less than 15 consecutive days</p>



<p>Second offense – not less than 30 consecutive days</p>



<p>Third offense – not less than 60 consecutive days</p>



<p>If arrested for a fourth offense of <a href="/Criminal-Defense/Sex-Crimes/Prostitution.aspx" rel="noopener noreferrer" target="_blank">prostitution</a>, an individual will be charged with a Class 5 Felony, and if convicted, will face a mandatory term of not less than 180 consecutive days in jail (or state prison).</p>

<p> According to recent reports by the AZ Republic, police have made 270 alcohol-related arrests as a result of Tempe’s Youth Alcohol Enforcement campaign targeting <a href="http://www.arizonaduidefenselawfirm.com/DUI/Minor-in-Consumption.aspx" rel="noopener noreferrer" target="_blank">underage drinking</a> and drunk driving. The Tempe Police Department, along with ASU Police and other state law enforcement agencies kicked off the campaign in an effort to reduce crimes often associated with alcohol and DUI violations, such as violence, <a href="/Mesa-Criminal-Defense-Blog/2012/April/Disorderly-Conduct-Disturbing-the-Peace.aspx" rel="noopener noreferrer" target="_blank">disorderly conduct</a> or disturbance of the peace (i.e. loud parties and gatherings) as well as injury or fatal auto collisions and other <a href="/Criminal-Defense.aspx" rel="noopener noreferrer" target="_blank">criminal violations</a>. The enforcement campaign will conclude the first week of May, after ASU graduation ceremonies/parties and police will be highly visible in downtown <a href="/Areas-We-Serve/Tempe.aspx" rel="noopener noreferrer" target="_blank">Tempe</a> and patrolling throughout the city during this time. </p>
