Mesa Municipal Court Criminal Cases

If you were cited and/or arrested on a misdemeanor criminal violation by the Mesa Police Department, you will likely be appearing in the Mesa Municipal Court. The Mesa Municipal Court has jurisdiction over misdemeanor offenses such as DUI (1st Time DUI, Extreme DUI, Super Extreme DUI, Underage DUI), Assault, Disorderly Conduct, Criminal Damage, Domestic Violence and other criminal misdemeanor charges as well as traffic violations, Orders of Protection and Injunctions Against Harassment. Mr. Buckallew has handled countless cases in the Mesa Municipal Court, is very familiar with the Judges and Prosecutors over there and has experience in handling all types of criminal and DUI cases in this Courthouse. The Courthouse is nearby our Tempe office and is located one block south of Main Street and one block west of Mesa Drive at:

Mesa Municipal Court

250 East 1st Avenue

Mesa, AZ 85210

The Court operates on a 4-day schedule and the hours of operation are Monday-Thursday 7:00 AM – 6:00 PM (excluding holidays).

Dress Code / Courtroom Etiquette

While your attorney will facilitate the court proceedings and give you instructions regarding your role during these various proceedings, it is always helpful to understand basic courtroom etiquette, including being on time, being polite to all court personnel, opposing counsel and the Judge, turning off electronic devices/phones and dressing appropriately. You want to make a good impression and impress upon the Court and Prosecutor that you are taking your case very seriously, and as such, your appearance and what you wear is important. Clothing should be free of offensive/controversial slogans, and no hats, cut-off shorts or flip-flops should be worn. Your appearance should not distract from your case or your defense and recommended attire would be ‘business casual’ such as a tucked in collared shirt and slacks for men and a blouse or sweater and slacks for women.

Types of Criminal Cases

The most common types of cases we typically see in the Mesa Municipal Court, include DUI, Disorderly Conduct, Domestic Violence, Shoplifting, Assault and Probation Violations. At this Firm, we have experience handling all types of misdemeanor (and felony) criminal cases in the Mesa Municipal Court and in courts throughout the Valley (and statewide).

How to Post Bond at 4th Avenue Jail

If a friend or member of your family has been arrested and booked into jail in Maricopa County and the Judge ordered that a bond be posted for their release, you may be wondering how to go about posting this bond. Bonds can be paid at the 4th Avenue Jail (north side of the building), located at:

Maricopa County 4th Avenue Jail

201 S. 4th Avenue

Phoenix, AZ 85003

Please note, the jail does not accept cash or credit cards – acceptable means of payment for posting a bond include, a Cashier’s Check, a U.S. Postal Money Order or a Western Union Money Order. These must be made payable to the Maricopa County Sheriff’s Office.

Once a bond is posted, it can take up to 48 hours for the inmate to be released. Also, please note: If an inmate has any other holds, including an immigration hold or a hold by another law enforcement agency, posting the bond will not enable the inmate to be released. If you have any questions or want to confirm any other possible holds that may prevent the inmate’s release, you may contact the Sheriff’s Information Management Services at (602) 876-0322. You will need the person’s full name, date of birth, and booking number (if you have it).

Also notable, any transactions over $10,000 will require that you provide your social security number in order to post the bond, which is a requirement of the Internal Revenue Service.

You can also use a bail bonds company and we will discuss the process for doing this in a separate post.

If you are facing criminal charges in Phoenix, a Board Certified Criminal Defense Attorney with this Firm offers a free, no obligation evaluation of your case. Mr. Buckallew has focused his practice primarily on criminal and DUI defense, representing countless individuals in Phoenix and throughout the State of Arizona for over the course of his career. The Firm has defended a wide range of criminal cases, from Disorderly Conduct and Domestic Violence cases to DUI cases all the way up to First Degree Murder cases. Mr. Buckallew has handled countless cases in the Phoenix courts – both the Phoenix Municipal Court (misdemeanor criminal/misdemeanor DUI) and the Maricopa County Superior Court (felony criminal/felony DUI). The Firm also represents individuals in the Maricopa County Justice Courts located in Phoenix, including the Arcadia Biltmore Justice Court, Desert Ridge Justice Court, Downtown Justice Court, Encanto Justice Court, Dreamy Draw Justice Court, Maryvale Justice Court, McDowell Mountain Justice Court, Moon Valley Justice Court, South Mountain Justice Court, and the West McDowell Justice Court (misdemeanor criminal/misdemeanor DUI). In addition to criminal and DUI cases, Mr. Buckallew also represents plaintiffs or defendants in Injunction Against Harassment/Order of Protection proceedings as well as Interfering with Judicial Proceedings cases.

If you are charged with a DUI in Phoenix, it is critical to seek competent legal counsel as these cases can result in significant fees/fines, potential for incarceration, increased insurance premiums, college/career repercussions, possible suspended or revoked driver’s license, possible probation, and the possibility of ignition interlock requirements and alcohol classes. DUI litigation requires knowledge in both criminal defense as well as a thorough understanding of the scientific evidence (blood, breath, etc.) and Mr. Buckallew has significant experience in both of these areas. With his Law Degree and continuing legal education along with his Master’s Degree in Forensic Science, Mr. Buckallew understands both the science behind the evidence as well as the potential legal defenses inherent in DUI cases. He has handled all types of DUI cases including (but not limited to), 1st Time DUI, DUI Involving an Accident, Underage DUI, Extreme DUI, Super Extreme DUI, Aggravated DUI, DUI with Multiple Priors, DUI Involving Homicide (or Injury), and DUI – Drugs. He has achieved successful outcomes for countless clients over the years, including full case dismissals, not guilty jury trial verdicts, favorable plea agreements, and aggressively defends each and every case he handles.

Avondale is one of the fastest growing cities in the West Valley, settled at the base of the Estrella Mountains and just a 15-minute commute from downtown Phoenix. Thousands of NASCAR and racing fans descend on this city each year, attending races at Phoenix International Raceway (PIR), which is a significant boost to the local economy. Located in the heart of the west valley, Avondale is also nearby the University Of Phoenix NFL Stadium – home to the Arizona Cardinals, as well as several baseball spring training facilities, including the Los Angeles Dodgers and the Chicago White Sox in neighboring Glendale; the Cleveland Indians and Cincinnati Reds in nearby Goodyear; the San Diego Padres and Seattle Mariners in Peoria; and the Kansas City Royals and Texas Rangers in Surprise. Being centrally located in the west valley, with close proximity to many sporting events, year round entertainment, educational opportunities, shopping, dining and family activities, Avondale continues to grow and its population is expected to double in the next 5-7 years from its current population of around 76,000.

Law enforcement in Avondale is handled primarily by the Avondale Police Department and misdemeanor criminal complaints are generally filed in the Avondale City Court while felony criminal complaints are generally filed in the Maricopa County Superior Court. If you are arrested by AZ Department of Public Safety (DPS) or another law enforcement agency, your case may be handled in one of the west valley justice courts, including Country Meadows Justice Court, White Tank Justice Court, Agua Fria Justice Court or one of the other west valley justice courts.

Queen Creek is a small town situated in southeast Maricopa County, with the southern portion of town overlapping into Pinal County. The town is a unique mix of housing sub-divisions, homes on acreage, farmers and ranchers, and despite its growth, Queen Creek still has that rural feel about it. The San Tan Mountains lie to the south of Queen Creek and offer plenty of recreational activities including hiking, biking, camping and the like. Queen Creek is also home to the only working olive farm and mill in the State of Arizona – Queen Creek Olive Mill, where visitors can tour the olive mill, stroll through the olive groves, enjoy casual dining, and purchase a variety of olive oils and other unique gifts. Schnepf Farms is another longtime local fixture in the town of Queen Creek, where visitors can dine at the bakery, enjoy a hayride, tour the farm, go veggie picking, visit the museum, and much more. Given its small town feel, abundance of recreational activities, and easy commute to Phoenix and other valley cities, Queen Creek has become one of the “best kept secrets” in Arizona.

The Town of Queen Creek contracts with the Maricopa County Sheriff’s Office (MCSO) to provide law enforcement services to the town as well as the unincorporated areas surrounding the town. If you are cited with a criminal violation in the Town of Queen Creek or surrounding unincorporated county islands, your case will likely be handled in the San Tan Justice Court, if you are being charged with a misdemeanor crime. Felony criminal charges are generally filed in the Maricopa County Superior Court. The southern portion of Queen Creek, which overlaps into Pinal County, is patrolled by Pinal County Sheriff’s Office (PCSO). If you were cited by PCSO, your case will likely be under the jurisdiction of one of the Pinal County Justice Courts, if it is a misdemeanor, or Pinal County Superior Court if it is a felony charge.

The Firm has represented countless individuals who have been criminally charged in Queen Creek, either by MCSO or PCSO, ranging from simple misdemeanor disorderly conduct charges to very serious felony Aggravated DUI and Aggravated Assault cases. Mr. Buckallew is committed to the defense of individuals charged with a crime and focuses his scope of representation on matters involving criminal litigation, including (but not limited to) allegations of DUI (including 1st Time DUI, Extreme DUI, and Aggravated DUI), Juvenile Criminal Matters, Underage Drinking, Minor in Possession, Drug Offenses, Disorderly Conduct, Domestic Violence, Assault, Theft, Shoplifting, Probation Violations and any other criminal violation. He has a proven track record of successfully resolving countless cases over the course of his career. Mr. Buckallew has also recently been elected as a National Trial Lawyers Top 100 Trial Attorney for 2012.

What is a crime involving moral turpitude?

According to Black’s Law Dictionary, moral turpitude is defined as “Conduct that is contrary to justice, honesty or morality.” It is important to understand the consequences if convicted of a crime involving moral turpitude (CIMT), particularly as it relates to immigration matters. These types of crimes can also have an impact on a person’s ability to pursue meaningful employment, as prospective employers may call into question, a person’s honesty or integrity if these types of crimes are found during a background search.

What types of crimes are deemed to be crimes involving moral turpitude? The more common crimes include the following:

Crimes against a person such as Murder, Voluntary or Reckless Manslaughter, and Kidnapping are considered CIMT’s. Immigration law also considers Child Neglect, Child Abuse, Domestic Violence, Stalking and repeated Harassment as CIMT’s.

Sexual Offenses such as Rape, Prostitution and Possession of Child Pornography are considered CIMT’s.

Crimes Against Property such as Breaking and Entering to commit Larceny, crimes of Theft, and Trafficking in Counterfeit Goods are considered CIMT’s.

Crimes Involving Fraud – Most crimes involving Fraud either against the government or individuals are considered CIMT’s, as well as making false statements to obtain a passport, driver’s license, firearm application, passing bad checks, and fraudulent use of a social security number.

The immigration consequences, if convicted of a Crime Involving Moral Turpitude can lead to deportation under U.S. immigration statutes, if an alien has no U.S. immigration status. The alien is subject to exclusion from the U.S. for a minimum of 15 years and can also establish a basis for deportation, under certain circumstances, of aliens who have some immigration status, according to a recent article in The Champion magazine (published by NACDL). Because of the significant immigration consequences associated with Crimes Involving Moral Turpitude, it is critical to seek the advice of an experienced attorney who understands the impact of these types of crimes, before making any decisions in your case.

Not only can these crimes have an impact on immigration status, but CIMT’s can also have long term consequences for citizens of this country, particularly in an individual’s pursuit of a meaningful career. It can be very difficult to gain employment with a criminal record and the stigma of this record can follow a person for a lifetime. While there are laws protecting individuals from employment discrimination, public employers in the State of Arizona may deny employment to an individual with a criminal record if there is a reasonable correlation between the type of conviction and the position being sought after. For example, if a person has a drug conviction, an employer may determine that this will have no impact on handling the duties of an office clerk, if that individual is otherwise qualified. However, if the person is seeking a position as a pharmacist, then the drug conviction may be an impediment to obtaining a position in this field. As such, employers such as banks or other financial institutions, cashiers, or other positions that involve the handling of money or other valuable items, may be hesitant to hire someone who has been convicted of Theft, Fraud, Financial Crimes, or other Crimes Involving Moral Turpitude. Because the laws regarding employment, with respect to convictions of crimes involving moral turpitude are riddled with complexities, it is imperative that you seek the advice of legal counsel before making any decisions that may have a long lasting impact on your livelihood.

What are Protective Orders?

Individuals seeking to restrain a person from acts of domestic violence, harassment, coming near a residence, place of employment or school can obtain a Protective Order in any court in the State of Arizona. If you reside in Scottsdale, chances are you will be seeking an order in the Scottsdale City Court, or other nearby City/Municipal or Justice Courts in your community, including Paradise Valley Municipal Court, Biltmore Arcadia Justice Court, Desert Ridge Justice Court or McDowell Mountain Justice Court. An Order of Protection is generally requested when an individual is seeking protection against a spouse, former spouse, roommate, or other blood relative. If the person you are requesting the Order against does not qualify as a spouse, relative, roommate, or other designated domestic relationship, you will need to request an Injunction Against Harassment instead of an Order of Protection. An Injunction is typically sought when disputes arise between neighbors, co-workers, or other non-domestic relationships.

When requesting an Order of Protection, a Judge can issue the Order if he/she finds that the defendant may, or has committed an act of domestic violence. Domestic Violence Crimes can include Assault or Aggravated Assault, Child Abuse, Criminal Damage, Crimes Against Children, Disorderly Conduct, Harassment, Threatening and Intimidating and other related crimes. The Judge may order either party not to commit acts of Domestic Violence; prevent either party from coming near the residence or place of employment; grant one party full use of the residence; and order any other relief that may be necessary to ensure protection. The Judge may also prohibit the Defendant from possessing or purchasing any firearms as a condition of the Order, and shall subsequently order the Defendant to turn over any firearms to the appropriate law enforcement agency.

If the Judge issues the Order of Protection, it is the Plaintiff’s (requestor’s) responsibility to have the Defendant served before the order will become effective. Once served, the Order is in effect for twelve months. During this time, the Defendant can request one hearing any time during the twelve month effective date. The Judge will hear testimony and make a determination whether the Protective Order should be quashed or upheld. If at any time during this twelve month time frame the defendant violates the Order of Protection, he or she can be charged criminally for violating the Order of Protection or Injunction Against Harrassment.

This Firm can represent either a Plaintiff or Defendant seeking representation during any court proceedings requested by either party. The Firm also represents individuals facing criminal charges resulting from allegations of violating a Protective Order or Interfering with Judicial Proceedings (Class 1 Misdemeanor), or any other domestic violence crime.
